What rights does a Muslim wife have if her husband refuses to give talaq?

Muslim wife rights when husband refuses talaq
What rights does a Muslim wife have if her husband refuses to give talaq?

Answered by

Quran 2:229. UK Divorce Dissolution and Separation Act 2020. Shariah Council UK

A husband refusing talaq does not leave a wife trapped. Islam gives her the right of Khul; she initiates separation by returning her mahr to the husband. If he still refuses, a Shariah Council scholar can dissolve the marriage on her behalf. In the UK, she can also file for civil divorce without his agreement under the 2020 No-Fault Divorce Act. Both Islamic and legal routes are fully available to her. A Muslim wife is never trapped; Islam and UK law both protect her exit.
