Is Your Nikah Legal in Turkey? Explanation from Turkey and Istanbul(2026)

General information, not a legal opinion! Last reviewed October 2026.

Introduction

With the imam's declaration of nikah, the Muslim couples in Turkey think they are married. However, they could be religious. Is not legally recognized. Turkish law only recognises a civil marriage and a religious marriage does not confer any rights over property or inheritance, divorce or next of kin status. This is important for Turkish couples, and for the thousands of expatriates and foreign Muslims who live in Istanbul and other cities. This guide outlines what is considered to be a nikah under Turkish law, what the potential dangers are and how to safeguard yourself.

Is a nikah legally valid in the UK? Things Every Muslim Couple Must Know

Can nikah be performed in Turkey?

An important consideration for those who are looking for a halal marriage in 2026 is the location of their rishta, especially in the United Kingdom in major cities such as London, Birmingham, Leeds, Bristol, Sheffield, Glasgow, Liverpool, or Manchester.

Are there any Nikahs in Turkey?

No. In Turkey, marriage is only recognized as a valid marriage if performed by a marriage officer in a civil marriage ceremony.

Religious Nikah (imam nikahı) does not have any legal effect. In Islam, a nikah that fulfills its requirements is a valid marriage. According to the Turkish law, if only a nikah is performed, it does not make them married.

Is Nikah Without Civil Marriage a Crime?

It used to be. Until 2015, the Turkish Penal Code had two- to six-month prison terms for a person that held a religious ceremony without a civil marriage and for the imam who performed it.  On 27 May 2015, the Constitutional Court has declared the same penalties invalid. This ceremony is no longer an offence if it is only used in a religious context. No longer will it be an offense for a religious ceremony to be held, but it will still not be legally binding.  Even the Civil Code states that the couple must present their Civil Marriage booklet (aile cüzdanı) prior to the religious ceremony; the imams generally request to see the Civil Marriage booklet.

Why Nikah Alone Is Not Legally Protected in Turkey

In Turkey, Nikah cannot be legally recognized because it does not grant you civil law rights in regard to divorce, money, property, or inheritance. This is where it gets serious.

If you only have a nikah:

  • You may have no legal claim to shared property
  • You may not be entitled to financial support after separation
  • You may have no inheritance or next-of-kin rights
  • A court cannot grant a divorce because there is no legal marriage to dissolve

After a long nikah-only marriage, one partner, usually the wife, can be left with very few legal rights.

What Happens If You Only Do Nikah? (Real Risks)

There are many couples that don't consider the worst case scenario. When you're separated or someone dies, you might not have anything in your favor. It's very difficult for anyone, and particularly for couples that have been together for years, especially for women. Consult with a lawyer about how the law applies to your case and take the time to consider a civil marriage as soon as possible.

How to Legally Register Your Marriage in Turkey?

In order to be legally married, one has to have a civil marriage registered in Turkey. One can perform both: civil marriage for legal and religious marriage for validity. The steps are:

Fill out an application at the marriage office (evlendirme dairesi) of your district municipality. Each district of Istanbul has its own.
Take ID card/ passport, health report, photographs and Application form. Additional paperwork, including a certificate of freedom to marry, and certified translations, is typically required for foreign nationals. Select a date, and get married before the marriage officer and witnesses.
Get your marriage booklet (aile cüzdanı) at the end of the ceremony.
Hold your nikah or religious ceremony afterwards, if you wish.

Conditions are subject to change and please consult your municipality and your embassy for the latest list. If the woman who has divorced is also subject to a waiting period, she will need to check with the marriage office as well.

Islamic Perspective vs. Turkish Law.

In Islam nikah makes a marriage valid, but in Turkey, only a registered civil marriage is valid. These two systems are distinct and must be studied in its entirety. It is crucial to be aware of this. The central theme of Islam is the religious legitimacy of marriage.

Turkish law focuses on legal rights and protection. So you need both. Doing only nikah is not wrong Islamically. But it is incomplete legally.

Balancing both protects your deen and your rights.

Top Tips for Muslim Couples 2026

If you are a Muslim couple getting married in 2026, it is important to have a legal civil marriage in 2026 in addition to the nikah to avoid possible issues and protect the rights of each partner.

If you are planning a marriage:

  • Don’t rely on nikah alone
    Always register your marriage legally
    Discuss this openly before marriage
    Make sure both families understand

Many Muslim married couples assume things will be fine. But it’s better to be careful now than apologize later. This matters even more if you met online and moved quickly toward marriage. Slow down, and make sure the legal side is done.

  • Agree on your mahr in writing, and ask a lawyer how it is treated
  • Decide whether to have a marriage contract about property before you marry
  • Keep copies of your passports, civil marriage booklet, and nikah paperwork
  • If you are a foreign national, check how Turkey and your home country each treat your marriage

Frequently Asked Questions

Is the imam nikah (religious marriage) valid in Turkey?
No. Turkish civil law only recognizes marriages conducted in front of a marriage officer. No law that establishes a religious ceremony as a lawful relationship.

Why it is wrong to get married without a civil marriage?
Not any more. In 2015 the Constitutional Court invalidated the criminal penalties. Even the nikah does not give any legal rights, even with the Civil Code one must present the Civil Marriage booklet before going to a religious marriage.

Are foreigners allowed to marry in Turkey?
Yes, in the Marriage Office of a District Municipality. The foreign nationals will need to provide further documentation and translations – contact the municipality for details and your Embassy.

Which one is to be performed first, the civil marriage or nikah marriage?
Civil marriage is first of all. The usual practice is for imams to request to see the marriage booklet prior to a religious wedding and many couples perform the marriage ceremony after.

Is marriage a pathway to citizenship or residence in Turkey?
It must be a civil marriage that has been legally registered and the conditions vary. Contact an immigration lawyer to find out about the current rules.

We only did a nikah. What should we do now?
Hold a civil marriage as soon as you can, and ask a lawyer how to protect your property and rights from the earlier period. Ask your imam for advice too.

Final Thought

Planning your marriage through a rishta or a matrimonial site? Do your nikah, and make it legal too. A strong marriage is built on love and intention, and also on security and responsibility.
